    FSSAI State Licence: When It Applies

    This page is the national owner for FSSAI State Licence intent. For new applications made on or after 1 April 2026, the general turnover band for a State Licence is above ₹1.5 crore and up to ₹50 crore. A State Licence is not defined merely as “a business operating within one State,” and turnover is not the only test.

    The current FoSCoS KOB matrix also uses activity, capacity, premises and location criteria. Some food businesses within the turnover band may fall under a category-specific State row, while a Central-only KOB can require a Central Licence even below ₹50 crore. Each application should begin with the exact KOB eligibility result.

    State Licence Eligibility Checks

    • General turnover: above ₹1.5 crore and up to ₹50 crore for KOB rows governed by turnover.
    • Manufacturing or processing: check both turnover and any product/capacity rule shown for the exact activity.
    • Storage, transport, trade and food service: use their separate FoSCoS rows; do not apply a manufacturer checklist by default.
    • Hotels and catering: star classification, institutional setting and turnover can alter the category.
    • Central exceptions: importers, e-commerce food businesses, specified exporters/export-oriented units, centrally controlled premises and other Central-only KOB entries must follow the Central route.

    Documents Required for an FSSAI State Licence

    There is no reliable universal State Licence document list. FoSCoS displays documents for the selected KOB. Depending on the activity, the list may include Form B information, entity and authorised-person records, premises proof and layout, food-product details, equipment or capacity particulars, a food safety management plan, water analysis, technical-person details, or a KOB-specific NOC or declaration. Only items shown for the actual category should be represented as mandatory.

    Kickstart practical guidance: reconcile the entity name, premises address, installed capacity, food-product list and responsible-person details before filing. This reduces avoidable inconsistencies but does not ensure grant.

    State Licence Application Process

    • Run the current FoSCoS eligibility check for the exact premises and KOB.
    • Select the State Licence result and review the KOB-specific document list.
    • Prepare Form B details and the supporting documents shown by FoSCoS.
    • Submit the application and pay the government amount calculated by the portal.
    • Answer authority clarifications and cooperate with an inspection if the risk-based process selects one.
    • After grant, display the licence and comply with the applicable licence conditions and ongoing food-safety obligations.

    Inspection is not a universal, identical stage for every State Licence application. The 2026 framework uses risk-based inspection and food-safety audit inputs, including compliance history, surveillance, self-compliance testing and third-party audits. A compliant history may reduce repeated inspections; the authority can target higher-risk or repeat non-compliant businesses.

    Government Fee and Validity

    The current FoSCoS KOB matrix displays State Licence amounts that vary by activity, commonly ₹2,000, ₹3,000 or ₹5,000. The exact payable amount must be taken from the live eligibility/application result. Kickstart’s professional fee, if engaged, is separate.

    State Licences now have perpetual validity unless suspended, cancelled or surrendered. Routine renewal before an expiry date should not be promised or instructed under the 2026 framework. Modification, compliance, inspection, returns, testing, hygiene and other category-specific duties continue.
